Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement

Please read this agreement carefully! By agreeing to this Release Agreement you will waive certain legal rights, including the right to sue.

1. Assumption of Risk

I am aware that participating in surfing or riding a bicycle involves inherent risks, including the risk of serious injury or death. These risks include, but are not limited to: collisions with pedestrians, vehicles, other surfers, or stationary objects; changing weather, wind, or ocean conditions (including rip currents and tides); and my own physical condition or lack of experience. I am aware that there is a risk of negligence by LBBR or its agents, including the failure to safeguard or protect me from the hazards of these activities. I freely accept and fully assume all such risks, dangers, and hazards.

2. Waiver of Claims and Release of Liability

In consideration of the equipment rental, I hereby agree:

  • To waive any and all claims that I have or may in the future have against LBBR and to release LBBR from any and all liability for any loss, damage, expense, or injury, including death, resulting from my rental due to any cause whatsoever, including negligence, breach of contract, or breach of any statutory or other duty of care on the part of LBBR.

  • To hold harmless and indemnify LBBR from any and all liability for property damage or personal injury to any third party resulting from my participation in this rental.

  • This agreement shall be effective and binding upon my heirs, next-of-kin, executors, administrators, assigns, and representatives.

3. Governing Law and Jurisdiction

This Agreement shall be governed by and interpreted solely in accordance with the laws of the State of New York. Any litigation involving the parties to this Agreement shall be brought solely within the State of New York, specifically within the courts of Nassau County.

4. Equipment Condition and Duty to Inspect

I understand that I am responsible for inspecting all rented equipment (bicycles, surfboards, etc.) immediately upon delivery. I agree not to use any equipment that appears damaged, broken, or unsafe. By accepting delivery and beginning my rental period, I acknowledge that the equipment is in good working order and I accept full financial responsibility for its return in the same condition, barring normal wear and tear. I agree to pay all repair or replacement costs for any damage or theft occurring during the rental period.

5. Representation of Authority (Group/Minor Clause)

If I am booking on behalf of other participants (adults or minors), I warrant that I have the express authority to sign this Release on their behalf. If I am signing for a minor, I warrant that I am the parent or legal guardian. I agree to defend and indemnify LBBR against any future claims or lawsuits brought by any participant listed below who claims they did not authorize this waiver.

Who will be using the rented equipment?

Please list all individuals who will be participating in the rental activity. By adding these names, you acknowledge that this Release of Liability and Assumption of Risk agreement applies to all participants listed below.
